Terms of Service

1. Acceptance of terms

By registering for or using Immigranter ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a practice or organisation, you represent that you have authority to bind that organisation to these Terms.

If you do not agree to these Terms, do not use the Service.

2. Description of the Service

Immigranter is a practice management platform for migration agents and immigration lawyers. It provides tools for managing client records, applications, checklists, document collection, and client communication, including a client portal.

Immigranter is not a visa eligibility tool, lodgement tool, form-filling platform, or document signing service. It does not submit applications to any government portal. Nothing in the Service constitutes legal advice.

3. Account registration

You must register for an account to use the Service. You agree to provide accurate information and keep it up to date.

You are responsible for all activity that occurs under your account. Keep your login credentials secure. If you suspect unauthorised access, notify us immediately at support@immigranter.com.

Accounts are for use by the registered practice and its team members. You may not share accounts with people outside your practice.

4. Subscriptions and billing

The Service is offered on a subscription basis. Plans are billed monthly or annually depending on your selection. Billing is processed by Stripe.

Free trial — new accounts receive a 14-day free trial on the Professional plan. No credit card is required to start the trial. At the end of the trial period, you must select a paid plan to continue using the Service.

Payment — by providing a payment method, you authorise us to charge you for the selected plan on a recurring basis.

Plan changes — you can upgrade or downgrade your plan at any time from within the app. Changes take effect at the next billing cycle.

Cancellation — you may cancel your subscription at any time. Access continues until the end of the current billing period. We do not offer refunds for unused portions of a billing period.

Price changes — we may update pricing with 30 days' notice. Continued use after the notice period constitutes acceptance of the new pricing.

5. Your data

You retain ownership of all data you enter into the Service, including client records, documents, and case information.

You grant us a limited licence to store and process your data for the sole purpose of providing the Service.

You are responsible for ensuring you have the right to collect and store any personal information you enter, including your clients' information. You must comply with applicable privacy laws in your jurisdiction.

We do not access your client data except to provide the Service or respond to a support request you initiate.

6. Acceptable use

You agree not to use the Service to:

- Violate any applicable law or regulation - Store or transmit content that is unlawful, harmful, or fraudulent - Attempt to gain unauthorised access to any part of the Service or its infrastructure - Interfere with or disrupt the Service or its servers - Reverse engineer, decompile, or attempt to extract the source code of the Service - Resell or sublicence the Service to third parties without our written consent

We reserve the right to suspend or terminate access for any user who violates these conditions.

7. Client portal

The client portal allows your clients to access their matter information via a single-use email link. Your clients do not create an Immigranter account.

You are responsible for the accuracy of client contact details used to send portal access. You must obtain any necessary consent from your clients before enabling portal access.

Portal access links expire after 48 hours. Staff can revoke access at any time.

8. Uptime and availability

We aim to maintain high availability of the Service but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance where possible.

We are not liable for any loss arising from downtime, outages, or data unavailability beyond our reasonable control.

9. Intellectual property

All software, design, and content that forms the Immigranter platform is owned by or licenced to us. These Terms do not grant you any rights to our intellectual property other than the right to use the Service as described.

You may not copy, reproduce, or create derivative works from any part of the Service without our written permission.

10. Limitation of liability

To the maximum extent permitted by applicable law:

- The Service is provided "as is" without warranty of any kind - We are not liable for any indirect, incidental, special, or consequential loss arising from your use of the Service - Our total liability to you for any claim arising from these Terms or your use of the Service is limited to the amount you paid us in the 12 months prior to the claim

Nothing in these Terms excludes liability that cannot be excluded by law, including consumer guarantees under the Australian Consumer Law.

11. Termination

We may suspend or terminate your account if you breach these Terms, fail to pay for the Service, or for any other reason with reasonable notice.

On termination, your access to the Service ends. Your data is retained for 90 days before permanent deletion. Contact support@immigranter.com if you need to retrieve data before that period expires.

12. Governing law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms or your use of the Service are subject to the exclusive jurisdiction of the courts of New South Wales, Australia.

13. Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
